General conditions of use

Platform

Mandatoo (hereafter the platform) is an offer in the area of community services. It comprises all contents and services available through mandatoo.com addresses (including national levels, and all relevant sub-areas)

Service provider

The company Etucom sàrl (hereafter the "service provider") is the owner and user of the platform. The "human resources" section is managed by Leekeed sàrl.

Users

Any physical or juridical person with an access to the platform is a user. All users who do not accept the present conditions must forfeit their membership.

Validity

The present conditions are valid for all relationships established between users and beneficiary. Any other condition put forward by users will on no account be taken into consideration. The service provider reserves itself the right to modify these conditions at any moment and without justifications.

Member status

As soon as a user registers on the platform as a member, he or she becomes a de facto member. A user name and password are immediately put at his or her disposal. All members are personally answerable for the information they insert into their accounts concerning themselves. False information given deliberately or with fraudulent intent on their accounts or in other areas of the portal - namely false identities ? are forbidden.
The service provider has to right to disable an account without justification.The service provider can on no account be called to legal account if a member's account is used or usurped by another person. All users have the right to call or email asking for the immediate deactivation of their account, without stating their motives.

Usage and protection of the user's personal data

The service beneficiary does everything within its power to guarantee the respect of the private sphere. The user's personal data are handled with special care, and conform with Swiss law concerning data protection in telecommunications. The user's personal data are neither commercialised nor exchanged.

Copyright

It is understood that the totality of information available through the platform is protected by copyright, and that it can only be used outside the platform with the service provider's consent, and in exchange for a fee.

Responsibilities of the service provider

The service provider declines responsibility for any economical, physical or immaterial damage linked to the use of the platform.

The platform contains links to other websites, as well as contents provided by third parties. The usage of these contents does not depend on the service provider. The latter declines all responsibility concerning the availability of these external contents, or the damage the usage thereof may incur.

The information published on the platform may be modified at all moment. The service provider declines all responsibility concerning their exactitude. The provider can in no case be held to account if this data is erroneous, lost, erased or sent to the wrong address. It also declines all responsibility for wrongful access to a user's personal information by a third party.

The service provider reserves itself the right ? without this being in any way an obligation ? to control the respect of law and legislation, the content of all transmitted text, photos or graphics, and to modify or erase the latter if necessary.

The service provider strives to ensure the proper and regular operation of the platform, but cannot guarantee an uninterrupted usage of or regular access to the platform; neither is it responsible for delays, or communication breakdowns due to technical difficulties. Technical difficulties or necessary maintenance work, for instance, may incur momentary interruptions in transmission.

Responsibilities and obligations of the user

Users commit themselves to handling received messages confidentially, and to divulge them to third parties only with the express prior consent of their sender. Furthermore users commit themselves to making use of the platform without any abuses. Users may claim no economic entitlement regarding the use of this platform. All financial transactions are regulated by a contract and by the specific conditions relevant to the service proposed.

Partial nullity

If any dispositions within these general conditions were to be declared void or partially invalid, the other clauses would retain all their force and range. The same applies if there were to be a default in individual dispositions within general conditions.

Applicable law and place of jurisdiction

The present general conditions are subject to Swiss law. To the extent that it is legally authorised, the place of jurisdiction is the legal headquarters for the service provider (Lausanne)
